Arbitration
Coughenour v. Del Taco (2020) _ Cal.App.5th _ , 2020 WL 6817570: The Court of Appeal affirmed the trial court's order denying defendant's motion to compel arbitration in plaintiff's action alleging sexual harassment, wage and hour claims under the Labor Code, and other claims under the Fair Employment and Housing Act. Plaintiff began working for defendant when she was 16 years old. When she was first employed by defendant, she signed a "Mutual Agreement to Arbitrate" (Agreement). After plaintiff turned 18, she continued working for defendant for four months before she quit. Four months later plaintiff filed her lawsuit. The trial court properly concluded that plaintiff's filing of her lawsuit was a disaffirmance of the Agreement within the meaning of Family Code section 6710, because plaintiff filed her lawsuit within a reasonable time after her eighteenth birthday.
