Thomas E. Sharkey has been an active trial lawyer for over 50 years, handling a wide variety of cases in state and federal court. Tom is known for representing defendants, but in the early years of his law practice he represented plaintiffs. He was a senior partner with McInnis, Fitzgerald, Rees, Sharkey & McIntyre for over 30 years before joining Higgs, Fletcher & Mack as special counsel from 1999-2000. During his career, Tom has tried hundreds of cases, including personal injury, products liability, professional negligence (legal, medical, dental, accounting, real estate), insurance bad faith and insurance coverage, construction, employment, real estate, securities, aviation and business/commercial matters.
Tom has been a member of the American Board of Trial Advocates since 1967 and holds the highest rank of Diplomate (100 + civil jury trials to conclusion). He served on the ABOTA National Board of Directors from 2000-2005. Tom has also been a Fellow in the American College of Trial Lawyers since 1981.
Tom has received numerous awards during his career, including the following:
- University of San Diego School of Law Distinguished Alumnus Award (1978)
- Daniel T. Broderick III Memorial Award for Civility, Integrity and Professionalism (1990), first recipient, San Diego trial bar associations' highest award
- Best Lawyers in America (1995 to present)
- Consumer Attorneys of San Diego Trial Lawyer Hall of Fame (2010)
Tom started working as a mediator, arbitrator and referee in 1989. He has successfully mediated hundreds of cases and has served as arbitrator in a wide variety of cases. Tom provides mediation, arbitration, discovery referee and special master services through Judicate West.
